
Athlone Town Council Compulsory Purchase (No. 1) Order, 2011
The Athlone Town Council (hereinafter referred to as the local authority) in exercise of the powers conferred upon them by Section 76 of the Housing Act 1966 and the Third Schedule thereto, as extended by Section 10 of the Local Government ( No. 2 ) Act 1960 ( as substituted by Section 86 of the Housing Act 1966), as amended and extended by the Planning and Development Acts 2000 to 2010 and the Roads Acts 1993 to 2007, have made an Order entitled as above which is about to be submitted to An Bord Pleanala for confirmation.
Owners, lessees and occupiers of the land described in the attached Schedule will receive individual written notice of the making of the Compulsory Purchase Order.
If confirmed, the Order will authorise the local authority to acquire compulsorily the land described in the Schedule hereto for the purposes of constructing a new road at Drumaconn, Cornamaddy, Athlone.
If an objection(s) is/are received to the compulsory acquisition of land and such objection(s) are not withdrawn, An Bord Pleanala may, at it's absolute discretion, hold an oral hearing into such objection(s). Having considered the objection(s) and the report on any oral hearing that might be held, An Bord Pleanala may confirm the Compulsory Purchase Order with or without modification or refuse to confirm it.
If no objection is received to the proposed compulsory acquisition of land, if any objection made is withdrawn or if the Board is satisfied that the objection(s) relates exclusively to matters which can be dealt with by the arbitrator by whom the compensation may have to be assessed, the Board shall inform the local authority and the local authority may then confirm the Compulsory Purchase Order with or without modification, or refuse to confirm it.
A copy of the Order and of the map referred to in same may be seen at the offices of Athlone Town Council, Civic Centre, Church Street, Athlone, Co. Westmeath Monday to Friday (excepting public holidays) between the hours of 9.00 a.m. and 4.00 p.m.
Land coloured grey, bounded in red on the map attached to the Order, being land other than land consisting of a house or houses unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense.
